GENERAL TERMS & CONDITIONS

• The following Terms and Conditions do not affect (and are subject to) those of your statutory rights as a consumer, which cannot be excluded by law.
• It is your responsibility to provide adequate storage for the goods purchased. We will not take any responsibility for losses, damages or costs arising out of unsuitable, unsafe or inadequate storage conditions.
• The customer’s attention is drawn to application and usage information relating to the products, which are available on our Datasheets page accessible on our website at www.emperorpaint.co.uk. Additionally, this information is available on request by ringing 0161 509 9009 or emailing info@emperorpaint.co.uk.

DESCRIPTION OF PRODUCTS

• We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system.
• Whilst every effort is made to display as accurately as possible the colour of our products, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the goods on delivery. We strongly recommend purchasing a hand-painted colour card or tester pot to examine actual samples of the colour before placing your order.
• Orders will only be accepted if there are no material errors in the description of the products or their prices as advertised on this website.
• All items are subject to availability.
• Products are subject to change without notice. We reserve the right to add, remove, substitute or alter products on sale.
• Whilst every effort is made to ensure that colour matches are good between batches and products, the nature of the pigments and base materials used means that colours may vary. In addition to this, the effects of natural processes on painted surfaces may lead to colours changing over time. You must notify us of any colour discrepancies before use as we do not accept liability for any application costs in the event of these discrepancies being noticed after the paint has been used.

ORDERS

• Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products from us. We may send you an order acknowledgement email as soon as you place your order, and you will receive an order confirmation email detailing the Products you have ordered. These emails do not constitute acceptance of your order. Our acceptance of your order will take place only when we dispatch the product(s) unless we have notified you that we do not accept your order, or you have cancelled it in accordance with our instructions.
• Prior to dispatch of the product(s), we have the right to decline an order for any reason, including legal and regulatory reasons.
• Should we have taken payment prior to non-acceptance of your order then we will refund you, but please note that it can take up to 5 days for the bank to transfer the funds to you.
• We reserve the right to limit the number of a given item that can be bought by an individual customer should we deem it appropriate.
• We reserve the right to suspend your account and any associated accounts and contact you if we notice suspicious activity associated with your account or any associated accounts. In the event that this happens you will receive an email to notify you of this.
• If we cannot supply you with the product(s) you ordered, we will not process your order and notify you via email or telephone.

PAYMENT

• All goods shall remain in the sole ownership of Emperor Paint UK until such times as all monies payable have been received by us.
• You may pay by debit card, credit card or another alternative payment method specified as part of the checkout process.
• Payment is taken immediately.
• Should we have taken payment prior to non-acceptance of your order then we will issue a full refund by the method used to pay for the original transaction.

DELIVERY

• Our current free delivery offer is available to mainland UK customers only.
• Delivery times may vary upon on your location.
• All quoted delivery times are estimates only. Time shall not be of the essence in the delivery of any items and the vendor shall accept no liability in relation to late delivery beyond the value of the goods in question.
• Approved carriers will deliver your orders.
• All risk in the items you order (including risk of loss and/or damage to the items) shall pass to you when they are delivered to the delivery address specified in your order.
• All delivery services are subject to stock, courier area and availability and demand.
• We do not dispatch orders on weekends or bank holidays.

RETURNS

Private United Kingdom customers have certain cancellation rights under the Consumer Protection (Distance Selling) Regulations 2000 (the Regulations).

Emperor Paint UK offers the following returns policy:

• Items can be returned up to 28 days from date of purchase with a valid proof of purchase.
• All items must be returned:
• Unopened
• In their original packaging
• In resaleable condition
• Any customer wishing to exercise this right must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the items you wish to return and, where available, your phone number and email address. You must notify us either by telephone 0161 509 9009 or by email info@emperorpaint.co.uk prior to returning any items.
• You must arrange (at your own expense) to return the items to Unit 32, Peel Industrial Estate, Chamberhall Street, Bury, Lancashire, BL9 0LU, England.
• We will not be responsible for any loss or damage to the returned items in transit and, for this reason, we recommend that you use a recorded delivery service. If returned items are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.
• Items will be deemed returned when received by us at Unit 32, Peel Industrial Estate, Chamberhall Street, Bury, Lancashire, BL9 0LU, England.
• Once we receive the items, we will issue a full refund by the method used to pay for the original transaction, within a 7-day period.
• We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
• We are not able to offer returns for tinted paint, which is made to order and is therefore a bespoke product, unless the item is faulty.
• If the items you receive from us are damaged on arrival, you must notify us within 7 days of the delivery date in order for replacement goods to be re-sent free of charge. No such claim will be accepted outside of this time limit. Any such re-delivery is subject to the provision by you of such proof of damage or shortfall as we may reasonably require.
• If you identify a fault with an item, please notify us either by telephone 0161 509 9009 or by email info@emperorpaint.co.uk.

LEGAL COMPLIANCE

• You agree that you will not use, sell or supply any product(s) purchased from Emperor Paint in an unlawful manner.

DESCRIPTION OF SERVICE

• We currently provide users with access to a rich collection of on-line resources, including, information regarding Emperor Paint products and support services.
• The website is provided “as is” and we assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications.
• In order to use the website, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access or utilize free public access available through public libraries.

• Export Control laws prohibit the export of certain technical data and software to certain territories. No software from this website may be downloaded or exported to any such countries, companies and/or individuals that may be subject to such export restrictions. Emperor Paint does not authorize the downloading or exportation of any software or technical data from the website to any jurisdiction prohibited by Export Laws.

• In any event we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.

• We do not accept any liability whatsoever for the performance or non-performance of any goods beyond the value of those goods (for example, we shall not be liable in respect of wasted time or additional costs incurred by any person such as labour or scaffolding costs nor shall we be liable in respect of any alleged consequential losses of any person).

• Only you and Emperor Paint shall be entitled to enforce these Terms and Conditions. No third party shall be entitled to enforce any of these Terms and Conditions, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or the applicable local legislation.

LAW, JURISDICTION AND LANGUAGE

• Any matters that arise out of your use of this website (including any contract entered between you and us through the website) shall be governed by the laws of England and Wales and subject to the non-exclusive jurisdiction of the courts of England and Wales.
• All contracts for the purchase and sale of Emperor Paint UK products from the website shall be concluded in English.

SEVERANCE

• If any part of the Terms & Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms & Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms & Conditions.

We offer Lifetime Guarantees on a number of our products. These guarantees are in addition to your statutory rights.

DEFINITIONS

“Us” “we” “our” refers to Emperor Paint UK
“You” “your” refers to the end user
“Guarantee” refers to the Lifetime Guarantee
“Product” refers to products covered under the Lifetime Guarantee

PRODUCTS COVERED UNDER THE LIFETIME GUARANTEE

Products covered under the Lifetime Guarantee are Emperor Masonry Paint and Emperor Masonry Creme as supplied directly by us and applied to buildings or external surfaces in the United Kingdom, the Republic of Ireland, the Isle of Man and the Channel Islands.

COMMENCEMENT OF THE GUARANTEE

The Lifetime Guarantee period will commence once the application of the Product has been completed in accordance with the application instructions and datasheets.

Registration is not required.

DURATION OF THE GUARANTEE

The Lifetime Guarantee is for as long as you, the end user, is living in the property the Product has been applied to.

The Lifetime Guarantee is non-transferrable.

CONDITIONS & EXCLUSIONS

The Lifetime Guarantee is conditional upon the following and non-compliance at any time may (in our sole and absolute discretion) reduce, limit or invalidate the Guarantee:

• The Product must be correctly applied in accordance with the data sheets and application instructions.
• The Product must only be applied to those surfaces specified on the Product data sheets.
• Where the Product is found to be faulty or defective in material or manufacture, we will, at our sole discretion and free of material and labour charges, provide enough replacement Product to re-coat the failed area.

The following are not covered by the Guarantee:

• Failure to follow the application instructions.
• Areas where the surface beneath the paint has failed or delaminated, such as cracked render, structural movement, mechanical damage or external damage.
• Areas where the performance of the Product has been compromised by structural faults to the building or external surface such as blocked or broken gutters.
• The growth of organisms such as algae, lichens and moss. Cleaning the Product with a compatible cleaner every 12 months is recommended to prevent the growth of such organisms.
• Application of the Product over the top of elastomeric coatings.
• Application of the Product on retaining walls with excessive levels of moisture.
• Damage to the Product caused by faulty application, tampering, misuse, abuse, failure to take reasonable care or other non-compliance with our instructions.
• Damage to the Product caused by accident, fire, flood, explosion, lightning, or other extreme weather conditions.
• Force Majeure - we will not be liable for damage to the Product to the extent caused by a condition (for example, natural disaster, act of war or terrorism, riot) that was beyond your reasonable control.

OTHER IMPORTANT PROVISIONS

• If any part of the Terms & Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms & Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms & Conditions.
• Unless explicitly stated otherwise in these Terms and Conditions, these Terms and Conditions do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
• These Terms are governed by the laws of England and Wales and subject to the non-exclusive jurisdiction of the courts of England and Wales.
• All claims under the Lifetime Guarantee shall be concluded in English.
• We reserve the right to withdraw, amend or terminate the Lifetime Guarantee without notice. All purchases made in accordance with these terms and conditions and made prior to us withdrawing, amending or terminating the promotion will still be honoured.

HOW TO MAKE A CLAIM

• To claim under the guarantee please e-mail info@emperorpaint.co.uk with the following details:

• Date of purchase
• Copy of original invoice or some form of proof of purchase
• Description of the fault and photos/videos
• Contact details and address

• Further evidence, which may include the supply of additional photos, videos and an onsite visit by a representative of Emperor Paint, may be required to verify the claim.
• The outcome of your claim will be communicated to you within 90 days.
• If a claim is refused because the Terms and Conditions have not been met, our decision is final.
• All claims must be made in accordance with these Terms & Conditions.
• Claims must be submitted by the end user, or by a carer or guardian on behalf of the end user.

This Privacy Policy explains in detail the types of personal data we may collect about you when you interact with us. It also explains how we will store and handle that data, and keep it safe.

CUTTING IN GIVEAWAY

By entering this Prize Draw (“Prize Draw”), participants agree to be bound by the following terms and conditions.

This Prize Draw is open to all residents of the UK, aged 18 years and over, excluding employees of Emperor Paint. The Prize Draw is only open to individuals and companies and organisations are not eligible to enter. Individuals may submit entries based on works they have carried out on behalf of their employer, company or organisation, provided that the individual has personally completed the majority of the decoration works.

The Prize Draw ends at 23:59 (BST) on 29th February 2024. Entries must like this post, follow @emperorcuttingin AND Tag another account (1 entry per tag) or share this post to your story, if entered on Instagram. If entered on Facebook, entries must like @emperorcuttingin AND comment on the post.

Entries received after this will not be accepted. No responsibility is accepted by Emperor Paint for entries that are lost or delayed in transmission, incomplete, in an unreadable format, or illegible.

Emperor Paint may, at its full discretion, disqualify Prize Draw entries that are:
a.     deemed offensive, derogatory, abusive or promotes or endorses violence, homophobia, racism or any other socially unacceptable or illegal material in the sole opinion of Emperor Paint;
b.     automatically generated by computer;
c.     completed by third parties or in bulk (e.g., spam entries);
d.     illegible, have been altered, reconstructed, forged, or tampered with;
e.     photocopies and not originals;
f.      incomplete; or
g.     duplicated.

Emperor Paint reserves all rights to disqualify participants if conduct is contrary to the spirit or intention of the Prize Draw.

One winner will be selected at random.

The winner’s prize includes the merchandise/product that is displayed on the corresponding Instagram and Facebook post that the participant commented on.

There is no cash alternative for the prize.

The winner will be contacted via direct message for their email address. Emperor Paint reserves the right to re-draw the prize if the winner is not eligible, cannot be contacted or does not respond to contact or claim the prize within 14 days of email/message receipt.

To receive the prize, the winner will need to provide a valid email address which will be used by Emperor Paint for the sole purpose of fulfilling the prize. Once received, the will be organised within 30 days. If the winner fails to provide their contact details within 14 days of initial contact from Emperor Paint, the prize will be offered to the next chosen winner.

Emperor Paint reserves the right, with or without cause, to exclude any participants in this Prize Draw or withhold any prize where there has been a violation of any of these terms and conditions.

Emperor Paint’s decision on all matters relating to the Prize Draw is final and binding. No correspondence will be entered into.

Emperor Paint reserves the right to amend or withdraw this Prize Draw in whole or in part, temporarily or permanently, without prior notice. Emperor Paint reserves the right to substitute these prizes for prizes of equal or greater value if necessary, in its opinion. Emperor Paint reserves the right to hold void, suspend, cancel, or amend the prize where it becomes necessary to do so.

To the fullest extent permitted by law, Emperor Paint excludes:
a.     all conditions, warranties and other terms which might otherwise be implied; and
b.     any liability for any direct, indirect or consequential loss or damage incurred by any participant in connection with this free prize draw Prize Draw. This shall not be deemed to exclude or restrict liability for death or personal injury resulting from the negligence of Emperor Paint or its employees or agents.

Emperor Paint will only process your personal information as set out in the privacy policy. By entering the Prize Draw, participants agree that any personal information provided with their entry may be held and used by Emperor Paint or its agents and suppliers to administer the Prize Draw.
